Profile

Rachel Marcus is experienced in the full range of drafting, advisory and advocacy work in all her areas of practice. Her environmental law practice means that she is at home with contract, tort, commercial, public and European law and in both the civil and criminal courts. She also undertakes a range of civil and public work for government departments such as the Department for Work and Pensions, the Home Office and HM Revenue and Customs.

Rachel is recommended for Clinical Negligence in The Legal 500, 2010.

Environmental law

She has a growing environmental law practice, having acted as junior counsel in the judicial review of the Environment Agency in SRM v Environment Agency and in the leading inquiry into contaminated land at Sandridge. She is regularly instructed in civil, criminal and regulatory cases in all areas of environmental law both as junior and sole counsel.  She is a contributing author to 2nd edition of Burnett-Hall on Environmental Law.  She is an active member UKELA’s Wild Law Group and carries out pro bono work for the Environmental Law Foundation and Friends of the Earth’s Rights and Justice Centre.

Clinical Negligence and Healthcare

She has a keen interest in clinical negligence and healthcare, acting for both claimant and defendant. She regularly drafts pleadings, schedules and applications of all kinds as well as advising on quantum. She appears before the Mental Health Review Tribunal and is regularly instructed to appear in the Coroners Court. She contributed the chapter on Human Rights to the 4th edition of Powers and Harris on Clinical Negligence and has provided pro bono advice via the Bar Pro Bono Unit on disciplinary matters.

Personal Injury

She has extensive experience of advising, drafting and advocacy in personal injury matters of all kinds at both County Court and High Court level, including high value head injury cases. She is a member of the Personal Injury Bar Association.

Rachel is a member of UKELA, PIBA, ALBA and HRLA.
