Rachel Marcus is acting for a mother who is claiming negligence against an out-of-hours GP who failed to diagnose that her seven week old son was critically ill.

Papers were lodged at the High Court on 29 January in which the mother, Jean Peanberg King, detailed 31 alleged breaches of duty and negligence by Kuljeet Takhar, which she claims caused or contributed to her son, Axel, dying from pneumonia.

Mrs Peanberg King is bringing the action to “get answers” that were not provided at the inquest. She also wishes to bring to public attention her opinion that the out-of-hours services are not equipped to judge when there is a medical emergency.

Dr Takhar has yet to lodge his defence.
