Pritesh Rathod successfully represented the Claimant in a High Court trial relating to negligent treatment given to her by a Consultant Gynaecologist.

Mrs Scaddon proved that at a private gynaecology appointment, Mr Morgan negligently failed to see that she had in fact suffered a prolapsed uterine fibroid. This was not diagnosed until around 7 months later, whereupon Mrs Scaddon underwent a hysterectomy to remove the fibroid.

The Court was required to consider evidence about the doubling times of cancerous and non-cancerous tumours, before going on to find that it was likely that the fibroid had prolapsed at the time of Mrs Scaddon’s private consultation and so Mr Morgan should have seen it if exercising reasonable care.
