Instructed by Hausfeld & Co and led by Tim Otty QC alongside Ravi Mehta both of Blackstone Chambers, Emma-Louise Fenelon is advising Save the Children on its Third Party Intervention before the European Court of Human Rights in the case of  Duarte Agostinho & 5 Others v Portugal & 32 Others. The case concerns 6 children and young adults from Portugal who have brought an application against 33 States alleging breaches of their convention rights as a result of the States’ failure to take adequate steps to address climate change.

Save the Children is one of a small number of organisations granted permission to intervene in the case from an original application pool of over 50 organisations. Its observations address the relationship between climate change and children’s rights.
