Amy Mannion was successful representing the Home Secretary in an unlawful detention judicial review. In a detailed judgment, Alexander Nissen QC found that the Claimant had not been unlawfully detained and declined to provide declaratory relief for admitted breaches of policy. The judge further confirmed that the “critical test” when a detained person suffers mental ill health is whether facilities for treating the person whilst in detention are available so as to keep the illness under control and prevent suffering.
