Employment & Equality

Jim has appeared in many employment cases over the course of the last decade.  He has been instructed by unions in claims giving rise to issues of discrimination, whistleblowing and TUPE and often represents central government departments as a member of the Attorney General’s London ‘A’ Panel.

He is able to draw upon his wider experience in human rights, public law and mental health to inform his approach to claims in the Employment Tribunal.

Selected Cases

• A v Ministry of Justice: Instructed by the Senior President of Tribunals in a disability discrimination claim brought by a First-tier Tribunal panel member.
• Representing a public sector employer sued by an employee with gender critical beliefs following the removal of her comments on an intranet article celebrating the employer’s relationship with an organisation promoting trans rights.
• Representing the Ministry of Defence and a former Government Minister in striking out a claim brought by an interpreter who assisted NATO forces in Afganistan.
• Representing an American evangelical organisation in Equality Act proceedings against a commercial radio broadcaster that removed adverts publicising its events.
• Jones v Department for Work and Pensions: Appearing for the DWP at a 10-day final hearing relating to disability discrimination.
• Morris v Carmarthenshire County Council: obtained significant damages following the unfair dismissal of a former ski centre coordinator at Pembrey Country Park in Carmarthenshire. Following a five-day hearing, the tribunal held that Mr Morris had been unfairly dismissed, but that he had not been dismissed as a result of his alleged whistleblowing disclosures.
• P & Others v CMY: acted for the successful claimants in a heavily contested TUPE transfer case involving a group of nursery workers. The tribunal initially reconsidered its decision to find for the Claimants, but upheld that decision following written submissions.
• Perratt v City of Cardiff Council: disability discrimination relating to Asperger’s Syndrome.
• J & Others v S: advised the claimant care workers in relation to a holiday pay claim.
• CAM v HMRC: Represented HMRC in an unfair dismissal claim (decision pending).
