Justin Levinson represented the successful claimant in his damages claim arising out of sexual abuse he suffered whilst in the Cub Scouts in the 1960s. The claim was defended on the basis of limitation and vicarious liability. The Scout Association denied that it was liable for the actions of the abusing Cub Scouts Leader because the sexual assaults occurred after parades and away from Scout premises when the claimant was on his way home. It was said that there was no grooming or assaults during Scout activities. Nonetheless, Mr Justice Sweeting accepted the claimant’s argument that the abuse was closely connected with the Cub Scout Leader’s role and awarded damages of £120,000.
