The Appellant, a prominent campaigner for justice for sub-postmasters affected by the Horizon IT scandal, appealed against the decision of the ICO that the Post Office was not required to disclose guideline documents relating to the operation of the Horizon Shortfall compensation scheme. The appeal before the General Regulatory Chamber (First-tier Tribunal) was resisted by the Post Office on the basis that the documents were protected by legal professional privilege (section 42 FOIA 2000) and that the public interest was in favour of non-disclosure. The Tribunal’s decision is awaited.
