The challenge to the Information Commissioner’s decision to order the Post Office to disclose an email relating to ‘Project Brisbane’ was heard this week by the General Regulatory Chamber (First-tier Tribunal) in a one-day hearing. The Post Office’s appeal was resisted by the Information Commissioner and the Second Respondent on the basis that, although the email was protected by legal professional privilege (section 42 of FOIA 2000), the public interest favoured disclosure. The Tribunal’s decision is awaited.
