Natasha Barnes appears in the Court of Appeal today in AM v Secretary of State for the Home Department, the latest in a number of cases concerning the correct approach to assessing credibility in asylum appeals. The First-tier Tribunal and Upper Tribunal dismissed AM’s appeal but the Court of Appeal granted permission on the basis that the First-tier Tribunal had arguably erred in failing to reach discrete findings of fact on the core issues and instead dismissed the appeal on the basis of the overall credibility of A’s evidence.
