Philip Havers KC (emeritus member) and Jasper Gold have contributed a chapter, Breach of Duty, to the fifth edition of Principles of Medical Law, Laing & McHale eds, published by Oxford University Press. Principles of Medical Law is a leading practitioners’ textbook covering all aspects of medical law, with contributions from leading practitioners and academics. 

The chapter covers all aspects of breach of duty in clinical negligence, and has been updated in this edition to cover major developments such as McCulloch and informed consent, ‘pure diagnosis’ cases, the standard of care of very experienced and inexperienced doctors, as well as covering breach of the ECHR in the context of medical treatment.

Jasper Gold practises across medical, public, coronial and data protection law, and has spent time seconded to leading claimant and defendant medical law firms. He recently spent six months as the judicial assistant to the High Court, Kings Bench Division, and maintains an interest in academic law. He regularly gives talks and training on clinical negligence and medical law more widely.
