Mrs. Justice Lambert yesterday approved settlement in KSS v Oxford University Hospitals NHS Foundation Trust. The Claimant had suffered permanent brain damage because of the Defendant Trust’s failure promptly to diagnose and treat hypoglycaemia when he was only a few days old. Now a teenager, he suffers from developmental delay, reduced visual acuity and epilepsy. He will probably never attain capacity or achieve full time paid employment. Resolution of the claim was achieved just two weeks before trial was listed to commence in the Royal Courts of Justice.
