On Monday 2 December 2024, at Westminster Magistrates’ Court, District Judge Clarke discharged Carol Jurja from an extradition request on the basis that it would be a disproportionate interference in his rights to a private and family life under Article 8 of the European Convention on Human Rights. His extradition had been sought by a court in Romania to serve a sentence of 4 years, six months and 20 days for three offences of cybercrime, in which, through a phishing scam, Mr Jurja had received a total of around $42,600. The other offence concerned an attempt to register a car even though it was considered to be criminal property.

Whilst the judge decided that the offending was serious she concluded that he was not a fugitive from justice. Furthermore his son has been attacked the year before and was suffering from PTSD. The expert paediatrician had concluded that Mr Jurja’s extradition would be disastrous for his son.

It was on that basis that he was discharged.

Benjamin was instructed by Elena Jacobs of Coomber Rich.
