Isabel acted for the successful Defendant in a recent High Court clinical negligence breach trial, heard by HHJ Harrison at the Cardiff District Registry, Holley v Cardiff and Vale University Health Board. The trial concerned whether a laparoscopic hysterectomy involved excessive and therefore negligent force in the removal of the surgical specimen, resulting in ureter injury. The Judge determined that excessive force was not used, and that the injury instead resulted from positioning and non-negligent force being applied. No excessive force was recorded in contemporaneous notes. The Judge was satisfied that the Consultant Surgeon operating would not have failed to record, contemporaneously, if he was of the view that excessive force had been applied.
