The High Court will consider an application for judicial review brought by the FDA, a trade union representing senior civil servants.

The union challenges guidance issued to civil servants following the enactment of the Safety of Rwanda (Asylum and Immigration) Act 2024. The guidance is intended to apply in the event that a Minister decides not to comply with an interim measures indication given by the European Court of Human Rights, the purpose of which is to halt removal pending a final decision by that Court. The FDA asserts that the guidance to civil servants is inconsistent with the Civil Service Code, which forms part of civil servants’ terms of service, and which requires compliance with the law.

The High Court has listed a rolled-up hearing for 6 June 2024.
