Clodagh Bradley QC, instructed by Richard Money-Kyrle of Boyes Turner, acts on behalf of Edyta Mordel in respect of a claim for ‘wrongful birth’ because no screening for Down’s syndrome was carried out by the sonographer at the Royal Berkshire Hospital in 2014 when she attended for first trimester screening, having asked for the screening.

There is a dispute of fact, as the sonographer recorded ‘Down’s screening declined’ in the sonography report, but Ms Mordel says that she did not decline the screening; she wanted it.  The midwife did not discuss the outcome of the screening appointment when she reviewed Ms Mordel when she was 16 weeks pregnant and she could and should have offered her the quadruple screening blood test, it is argued on behalf of Ms Mordel.  The Defendant denies liability and contends that the sonographer and midwife did everything that they should have done.

The trial was heard by Mr Justice Jay in the Royal Courts of Justice in July 2019 and he has stated that he will hand down his judgment in October 2019.
