Emma successfully represented an NHS Trust at a fact-finding hearing to determine the cause of multiple fractures to a minor, M. The case, M (Care Proceedings: Finding of Fact Hearing: Fractures) [2017] EWFC B50 (14 July 2017) involved allegations made against several Trust employees by the minor’s parents.

Emma was instructed by Ashley Irons at Capsticks solicitors.

The 6-day hearing occurred in the context of care proceedings brought by the Local Authority in relation to the minor’s parents. The parents denied having caused any injury and suggested that these were caused as a result of a combination of injuries sustained during caesarean section, and M being roughly handled by one or more of the sonographers at the hospital during the course of an ultrasound scan.

The Trust were subsequently joined as intervenors and HHJ Perusko gave permission for a range of experts to assist in determining the likely cause of the injuries. In his judgment, he concluded that no Trust employee had caused or contributed to the injuries sustained.
