Philip Havers QC was successful in a key Court of Appeal case as to whether receptionists in the A&E Department of a hospital owe a duty of care to patients as to the information they provide (or do not provide) as to waiting times.
Were the Court to have found that such a duty was owed the consequences for the NHS would have been far-reaching. In the event, by a majority, the Court held that it was not.
