In CICA v Hutton and others Owain Thomas QC represented the Criminal Injuries Compensation Authority in the Court of Appeal for the second time in this long running case.

The previous Court of Appeal judgment is reported at [2011] EWCA Civ 1560. This case concerns the correct approach which the Upper Tribunal should take to judgments of the FTT in cases concerning the waiver of the time limit for making applications to CICA.

The applications relate to the killing of the father of two of the applicants in 1966. The case has implications for the correct approach to the assessment of the waiver provisions of the scheme for applications based on historic crimes.
