On Monday 7th November 2016, Sarabjit Singh will lead Matt Donmall in an important rating law case on the circumstances in which buildings under reconstruction should be subject to non-domestic (also known as business) rates.

Sarabjit and Matt will be acting for the valuation officer and will be seeking to uphold their victory on the issue in the Court of Appeal.

Arguing against them will be the ratepayer and also interveners in the form of the Rating Surveyors Association and the British Property Federation.

The case will have significant implications on the rateability of unoccupied buildings that are undergoing some form of works, and will raise a number of delicate rating law issues for Lords Neuberger, Kerr, Reed, Carnwath and Hodge to decide.

The case is called SJ & J Monk (a firm) v Newbigin (VO) and the hearing can be watched live on Monday on the Supreme Court website.

The Court of Appeal’s decision can be viewed here.
