The Upper Tribunal allowed HMRC’s appeal against a decision of the First Tier. The First Tier had been wrong to conclude that it was unreasonable for HMRC to refuse a Duty Deferment Account to an independent chain of petrol stations. Although the company had good commercial reasons for wanting to defer duty, HMRC had been entitled to give weight to the reality that it was not likely to be in a position to pay duty.
