David Hart QC appeared before the Court of Appeal in a challenge to the Environment Agency’s decision to limit Mr Mott’s catch of River Severn salmon to 5% of his historic catch. On 17 June 2016, the Court allowed the Agency’s appeal against the judge’s finding that the decision had been irrational. However, it said that the decision was unlawful in the absence of compensation because of Mr Mott’s property rights under A1P1.
