Elizabeth Rose has suffered from Crohn’s disease since she was 14 and now faces an “imminent” bone marrow transplant and chemotherapy which she fears will render her infertile. She has applied for funding on the NHS for her eggs to be frozen and she has faced “continuing refusal” by Thanet Commissioning Group.
Jeremy Hyam represented Elizabeth in a judicial review against this decision. He argued that the decision is unlawful ‘because it was and continues to be defended on the basis of a policy which is unlawful and out of date’ and directly discriminated on grounds of gender.
