Richard acted for a nurse in a disciplinary hearing brought against a newly-qualified nurse who, when applying for a job as a paediatric nurse, had not disclosed her partner’s convictions for sexual offences.

The nurse accepted that, although no question was asked on the application form and no explicit policy or guidance existed in relation to disclosing partners’ criminal convictions, the decision not to disclose such information to her employer voluntarily had been inappropriate. The Panel found her fitness to practise to be impaired but took no further action on her registration, enabling her to return to work.
