A girl who will be 18 years old on 23rd September 2010, was brain damaged at birth due to the negligence of Rochford Hospital, Essex and sustained extensive and permanent injuries which render her wheelchair bound, lacking meaningful speech and with extensive learning difficulties. Her mother cared for her almost entirely single-handed for very many years before starting to explore whether her profound injuries were the fault of the hospital.

Margaret Bowron QC, instructed by David Kerry of Attwaters, advised that a claim should be brought and it was started in August 2009. Liability was swiftly admitted and, thanks to co-operation between the 2 sides, the valuing of the claim was quickly dealt with and the settlement PPO package, which would amount to about £4m on a lump sum basis, was approved by Kenneth Parker J on 1st September 2010. He commended both sides on their sensible and speedy resolution of the case.
