Tim Hussein leading Claire Fox represented the children at a 3 week fact-finding hearing where a professional maternity nurse was identified as being the perpetrator of very serious non accidental injuries to two twins including multiple rib fractures and a skull fracture. At the conclusion of the evidence it was submitted on behalf of the children that the maternity nurse’s name should be published at the conclusion of any police investigation. It was submitted this was important for safeguarding purposes because as a non medical maternity nurse the perpetrator was not subject to any oversight by any regulatory body to whom findings could be disclosed. Due to a lacuna, registration with OFSTED was entirely voluntary and therefore technically the perpetrator could continue to work as maternity nurse with vulnerable young children. HHJ Rowe KC gave helpful guidance in the judgment regarding the factors to be balanced when deciding whether to name a perpetrator publicly.
