In the September edition of Family Law Journal Natasha Isaac and Farhana Shahzady explore the issues facing women going through the menopause during divorce proceedings, including evidence of effects of symptoms, and to what extent those symptoms can be shown to affect earning capacity.

The article asks questions such as what can be done within financial remedy proceedings to assist those whose earning capacity is affected by menopause, what factors practitioners should consider in running a ‘menopause case’. Isaac and Shahzady interrogate whether the current legal framework surrounding financial remedy orders provides adequate and equal provision for women on divorce in light of these questions. This ‘hot topic’ for financial remedy practitioners is addressed in advance of, and inspired by, the new survey published by the Family Law Menopause Project.
