Following the Supreme Court decision in Coventry v Lawrence, when will the court give an injunction and when will it award damages in lieu? How will damages be assessed?
Simon Sinnatt will assess the impact of the decision of the Supreme Court in the nuisance by motocross noise case of Coventry v Lawrence, now that the 4-stage Shelfer test for damages in lieu has been swept away and the dust has settled.
Paul Ashwell will then look at when injunctions have been ordered, and when damages in lieu, in covenant, easement and trespass cases, and how those damages have been assessed. Finally he will consider the effect of planning.
