Rowan Jenkins prosecuted on behalf of a District Council after a lengthy investigation in a case in which a company pleaded guilty to failing to ensure the health, safety and welfare of its employees under the Health and Safety at Work Act 1974. The case concerned an accident where an employee with no training or assistance was required to move a heavy object in an unsafe manner. It became unstable and fell onto him, causing fatal injuries. Company records revealed poor systems of training, little in the way of risk assessments and several warnings by the HSE and internal auditors that had gone unheeded.
