Personal Injury

The team here offers expertise across the full spectrum of personal injury work. It has a particular specialism in claims relating to child abuse and further handles complex, multiparty actions relating to a variety of areas, including product liability. This set receives instructions from both claimants and defendants across a broad range of personal injury-related claims. Its members are able to draw on their considerable expertise in both clinical negligence and health law, ensuring that they are heavily commended for their expertise in cases concerning catastrophic brain injuries. Another area of strength is multiparty group actions, and the group has considerable expertise of actions relating to the use of medical and pharmaceutical products. (Chambers and Partners 2013)

We handle personal injury litigation at all levels for both Claimants and defendants. Instructions come from individuals, Government Departments, health authorities and NHS trusts, trades unions, insurers, the police force and others. Cases arise out of clinical negligence, road traffic accidents, employment conditions, and child abuse in institutions and elsewhere. Members of Chambers have also been instructed In a variety of multi-party group actions including child abuse compensation cases, organ donations, the Mau Mau uprising claims, the Kenyan training area claims (unexploded ordinances) and the nuclear test veterans’ litigation.

We also have expertise in group actions arising out of the use of pharmaceutical or medical products, such as the Oral Contraceptive Group Litigation, the MMR Litigation, the DePuy Hip Litigation and the Myodil group action.

At senior levels, we deal with the most complex of high-value cases drawing on the considerable depth of medical knowledge and expertise we have gained from our related specialisms of clinical negligence and other health law matters. We have been involved for both claimants and defendants in many landmark personal injury cases in the House of Lords, the Supreme Court and the Court of Appeal (for details see the “cases” part of this section).
