An award of damages in nuisance to a person with a proprietary interest in a property would not necessarily rule out an award to a person living in the same property with no proprietary interest under Article 8 of the Convention, although the award of damages at common law to a property owner would normally constitute just satisfaction for the purposes of the Human Rights Act 1998
